Former Governor Siegelman wants out of the pokey…

January 1st, 2008 by Steve

 …according to the Press-Register:

Attorneys for former Gov. Don Siegelman asked a federal court Monday to release Siegelman from prison, citing a lower court’s delays in both preparing a trial transcript and providing reasons for the denial of an appeal bond.

Siegelman’s appeal of his 2006 conviction on bribery and obstruction of justice charges cannot move forward without the completed transcript of the 10-week trial.

“Governor Siegelman’s continued confinement, pending appeal, coupled with the trial court’s continued refusal to provide any legal explanation for incarcerating Governor Siegelman on appeal, has denied Governor Siegelman’s constitutional right to due process,” states the motion, filed with the 11th Circuit Court of Appeals in Atlanta.

My thought still remains the same.  Siegelman is probably guilty as hell and probably should reside in a cell.  However, his prosecution certainly seems to have been politically motivated and this should be more seriously investigated, too.  I’d much prefer having Alabama prisons filled with actually criminals than with people who have been found guilty of victimless crimes.

I think I agree with you. However, have you considered how Siegelman and Scrushy were prosecuted under extra-constitutional federal RICO laws?
